Terms of Service

Note: These terms have been drafted for general protective purposes and reviewed for coverage of vehicle-related liability. They are not a substitute for advice from a licensed attorney. We recommend legal review before your commercial launch.
1. Acceptance of Terms
By accessing or using 2 Wheels in Common (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users in the United States and Canada.
2. What the Service Is
2 Wheels in Common is a platform that helps motorcycle riders find each other, coordinate group rides and connect with local riding communities. We are a communications and coordination tool only. We do not organize, lead, supervise or participate in any ride. We do not inspect vehicles, verify rider qualifications or assess road conditions.
3. Assumption of Risk
Motorcycle riding is inherently dangerous. Risks include serious injury, permanent disability and death. By using this Service to find, join or organize rides, you expressly acknowledge and accept all risks associated with motorcycle operation, including but not limited to:
- Collision with other vehicles, objects or road hazards
- Road and weather conditions
- Equipment failure
- The actions or negligence of other riders, drivers or third parties
- Your own errors in judgment or operation
You assume full and sole responsibility for your safety and the safety of any passenger before, during and after any ride arranged through the Service. No use of this platform reduces or transfers that responsibility.
4. Release of Liability
To the fullest extent permitted by applicable law, you release 2 Wheels in Common, its owners, officers, employees, contractors and agents (collectively "2WC Parties") from any and all claims, demands, damages, losses, costs and expenses of any kind arising from or related to:
- Your participation in any ride or event coordinated through the Service
- Any injury, death or property damage sustained while riding
- The conduct, acts or omissions of any other user of the Service
- Road, weather or environmental conditions encountered during a ride
- Any vehicle defect or mechanical failure
This release applies whether or not the claim arises from the negligence of the 2WC Parties, to the maximum extent permitted by law.
5. Indemnification
You agree to defend, indemnify and hold harmless the 2WC Parties from and against any claims, liabilities, damages, judgments, awards, losses, costs and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Service
- Any ride, event or activity you organize, lead or participate in through the Service
- Your violation of these Terms
- Your violation of any applicable law, regulation or third-party right
- Any injury, death or property damage caused by you or your vehicle
6. Eligibility and Rider Responsibility
You must be at least 18 years of age to use the Service. By using the Service, you represent that:
- You hold a valid motorcycle license or endorsement required by your jurisdiction
- Your vehicle is legally registered and insured as required by applicable law
- You will operate your vehicle in compliance with all traffic laws
- You will not ride under the influence of alcohol, drugs or any substance that impairs your ability to operate a vehicle
- You will not use the Service while operating a vehicle
We do not verify licenses, insurance or vehicle registration. Compliance is solely your responsibility.
7. No Endorsement of Riders or Rides
We do not screen, verify, endorse or recommend any user, ride organizer, route or event listed on the Service. Participation in any ride is entirely at your own discretion and risk. We make no representations about the skill, experience or judgment of other users.
8. Limitation of Liability
To the fullest extent permitted by law, the 2WC Parties will not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of life, personal injury, property damage or loss of data, arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) $100 CAD or USD.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free or free of harmful components. We disclaim all implied warranties including merchantability, fitness for a particular purpose and non-infringement.
10. User Conduct
You agree not to use the Service to harass, threaten or harm other users, post false or misleading information, organize rides intended to violate traffic laws, or use the platform for any unlawful purpose. We reserve the right to suspend or terminate your access for violation of these Terms at our sole discretion.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Washington State, and you consent to personal jurisdiction in those courts. If you are a Canadian resident, you additionally agree that Washington law governs and waive any right to have disputes heard in Canadian courts.
12. Changes to These Terms
We may update these Terms at any time. We will post the updated version with a new "Last updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
